Ban the Box is once again a front-of-mind topic for every employer. In an effort to aid reentry and reintegration of job candidates with criminal records into the workplace, President Obama has requested Congress to pass legislation that will prevent employers from inquiring about criminal records on job applications. This doesn’t mean that a candidate’s criminal information will never be released to a company, rather it aims to delay criminal checks until later in the hiring process. The Ban the Box effort is designed to further level the playing field for rehabilitated job candidates and to promote equal opportunities.
As the new legislation goes to a vote, it will be even more critical for employers to understand the requirements and to ensure compliance with federal regulations. As such, employers are encouraged to work with labor attorneys, AA/HR professionals, NAPBS accredited background screening providers and ATS software vendors to guarantee recruitment compliance.
